Presented by Ms Anne Severin (DS Avocats), Mr Rahul Matthan (Trilegal), Mrs Caroline Chazard Meas (DS Avocats), Mr Jurriaan Kien (Alstom Transport) In order to be able to continue operating on some large markets, Western organisations have less and less chance but to accept to transfer their technologies to emerging countries. A few recent examples in aeronautics, energy and transport are illustrating this trend. Should we accept these transfers? Under what conditions? Is the legal environment in place protecting enough? Which contractual conditions should be negotiated? How do these transfers really happen? Four experts will try and answer these questions based on their experience of the field on three large Asian markets: China, India and Vietnam. Three attorneys living and working in each respective country will give their views: Ms Anne Severin (DS Avocats) on China, Mr Rahul Matthan (Trilegal) on India, Mrs Caroline Chazard Meas (DS Avocats) on Vietnam. Then, Mr Jurriaan Kien (Alstom Transport) General Counsel for Asia Pacific, will share Alstom large experience of technology transfer in Asia. Anne Severin is an attorney at law at the Paris Bar and partner of DS Avocats, in charge of China. She opened the DS Shanghai office in 1997 and is still working there. For more than ten years, she has been advising numerous western companies investing and transfering their technology to China. Rahul Matthan is one of the best recognized technology lawyers in India. His practice focuses equally on the areas of telecom, new media and technology. He advises technology companies in all aspects of the business from incorporation and funding to structuring intellectual property strategy, licensing and mergers and acquisitions. Caroline Chazard Meas is an attorney at Law at the Paris Bar, Partner in charge of DS Avocats office in Singapore. After having worked more than five years for DS Avocats in Vietnam, she coordinates DS offices and correspondents in Southeast Asia. Jurriaan Kien is the Transport General Counsel for Asia Pacific of Alstom. He has been working for Alstom for more than 8 years: in 2000 he was Head of Legal for the Transport Signalling Business and in 2002 he was appointed Associate General Counsel for Northern Europe and member of the Regional Management Committee. |
